The recent changes in the Italian domestic law about the limitation of liability of the road carrier give rise to interesting possibilities of defence which need to be explored case by case. Another important area of legal assistance is represented by the redress claims against the Italian Railway company under the CIM Convention in respect of damages ascertained at destination, whenever the liability of the through bill of lading carrier is affirmed. Sufficient evidence must be collected in such case to prove that the loss or damage occurred after discharge of the goods from the vessel.
