Transactions based on the NSF are constantly handled: first, in order to protect clients in the negotiations for the conclusion of the Memorandum of Agreement, subsequently, during the phase of preparation and control of the documents and, finally, by attending the closing meeting. Disputes in this matter are frequent, specially in connection with the conditions of the vessel upon delivery and the alleged violation of clause 11 of the NSF, in which case arbitration proceedings are the most appropriate method of solution.
